Health Information-Patient Privacy

Your health and medical information is private and protected by State and Federal Law. Under the Health Insurance Portability and Accountability Act (HIPAA), you are entitled to access to your Personal Health Records (PHR). The law sets rules and limits on who can look at and receive your health records.

Who Must Follow the Law?

  1. Healthcare Providers such as, doctors, nurses, pharmacies, hospitals, clinics, nursing homes and laboratories, etc
  2. Health insurance companies, HMO's, employers and group health plans
  3. Government health agencies that pay for health care, such as Medicare and Medicaid

What Information is Protected?

  1. Information on your personal health and medical records that healthcare providers place in your file
  2. Conversations your doctor or nurse has about your care
  3. Information about you from your health insurance provider
  4. Billing information regarding your treatment at clinics and hospitals

Your Rights under the Law

Under State and Federal Law, healthcare providers and health insurers are required to comply with your rights to;

  1. Ask for a copy of your medical records and any other health information
  2. The healthcare provider has the right to charge you a fee for this service
  3. This process may take up to 60 days to provide your medical records
  4. Have corrections added to your health information
  5. Providers are allowed up to 90 days to correct and update your information
  6. Receive a notice that tells you how your health information is used and shared
  7. “Opt-In or Opt-Out”- whether to give your permission before your information can be used or shared for certain purposes
  8. Your health information cannot be given to your employer unless you provide written permission- “Opt-In”
  9. It cannot used or shared for sales and marketing purposes without your authorization
  10. Share private notes about your mental health counseling sessions, alcohol and drug treatment or HIV/AIDS
